Worker’s Compensation

In the state of California, Worker’s Compensation is a series of laws that gives benefits to those who have had an accident at work. There are some exceptions but typically, this is a system of law that is a no-fault. But who is at fault really doesn’t matter when it takes place in a work environment.
These laws began in the early 1900s and provide for anyone injured at work to be able to get the medical attention that is needed. This person can be treated by a doctor for the accident and will not be filing a lawsuit against he employer. This law also provides for disability benefits for the injured person which is about sixty percent of their usual paycheck.
These worker’s compensation laws are made to be simple but rarely do they work that way. This can be a challenging process as the injured person is both recovering from the injury and fighting for his rights.
It is possible that a third party is the cause of the injury and in a case like this a civil law suit is then filed. This will be an attempt to get full compensation for the person who has the injury. There are statutes of limitations to this process and so it is important to act as soon as possible.
